End User License Agreement (EULA)

This document constitutes an electronic record under the Information Technology Act, 2000 and the applicable rules framed thereunder, including any amendments related to electronic records. It is generated by a computer system and does not require any physical or digital signatures.

Service Provider

Law Herald Infotech, based in Mohali, Punjab, provides access to its online legal research platform through the website http://www.lawheraldonline.in (hereinafter referred to as "the Service" and "the Publisher").

Acceptance of Terms

By accessing or using the website, the user acknowledges and agrees to be bound by the terms and conditions outlined in this End User License Agreement (EULA).

Modifications to the Agreement

The Publisher reserves the right to amend these terms, including subscription fees, at any time without prior notice. Such changes will take immediate effect upon publication on the website or direct communication to the subscriber.

License Grant

Upon full payment of the applicable subscription fee, the user ("Licensee") is granted a non-exclusive, non-transferable, and limited license to access and use the content and database available through the Service. The subscription fee is non-refundable and exclusive of applicable taxes, which shall be borne by the Licensee.

Subscription Validity and Feature Access

The license is valid for the subscribed term or plan. Any changes to the pricing will apply to the next renewal cycle. New features or third-party content introduced during the subscription term will be accessible only upon payment of any applicable additional fees.

Authorized Use

Access is limited to the Licensee and its authorized users. Usage must adhere strictly to the terms outlined herein.

Permitted Purposes

The license permits use solely for:

  1. Academic or educational research
  2. Teaching purposes
  3. Legal research in connection with a professional vocation
  4. Accessing up to 200 documents daily
  5. Copying or downloading a maximum of 10 documents per day, including citation prints.

Prohibited Uses

Authorized Users shall not:

  1. Use the Service for commercial gain.
  2. Reverse-engineer, disassemble, or create derivative works from the content.
  3. Employ data mining, robots, or similar tools to extract content.
  4. Reproduce, distribute, or transmit content beyond the terms of this Agreement.
  5. Integrate the Database with any other systems or platforms.
  6. Remove or obscure copyright and proprietary notices.
  7. Republish the database or its elements on any other platform or claim ownership.
  8. Use proprietary collections (including case compilations and citations) in any commercial or freely distributed content without express permission.

All rights not expressly granted herein are reserved by the Publisher.

Local Storage Restrictions

Users may cache data locally only for active use. Storing or transferring such data in any retrieval system or format outside the license scope is strictly prohibited.

Termination of License

The Publisher may terminate the license immediately and without notice in the event of:

  1. Breach of any license terms
  2. Misuse or excessive usage of the Database by the Licensee or their representatives.

No refunds shall be issued upon termination. All access must cease immediately.

Disclaimer on Usage

The Licensee acknowledges that the Database is a reference tool and not a replacement for professional legal judgment. Decisions should not be made based solely on the content without proper verification.

Liability Disclaimer

The Publisher shall not be liable for any errors, omissions, or reliance placed on the information provided. No liability is accepted for consequential damages or inconveniences.

Force Majeure

The Publisher shall not be responsible for delays or interruptions due to circumstances beyond their control, including natural disasters, government actions, or technical failures.

Accuracy and Limitations

While efforts are made to ensure data accuracy, no warranties are provided. Overruled cases may not be exhaustively marked, and users are advised to cross-verify such information before use in any official proceedings.

Indemnification

The Licensee agrees to indemnify the Publisher for any losses or damages arising from misuse or unauthorized use of the Database by the Licensee or its associates.

Service Interruptions

The Publisher is not responsible for service interruptions, delays, or defaults, irrespective of cause.

Ownership of Content

This license does not confer ownership rights. All copyrights and ownership of the content, software, and publications remain solely with the Publisher.

Proprietary Rights

The Publisher holds exclusive rights to license the Database and all associated intellectual property, including publications and platform software.

Non-Transferability

The Licensee may not transfer or assign the rights granted without prior written consent from the Publisher.

Action on Misuse

In suspected misuse:

  1. The Publisher may revoke access without explanation or refund.
  2. Renewal may be denied.
  3. Service requests may not be fulfilled.

Governing Law

This agreement shall be governed by the laws of India.

Severability

If any provision is deemed invalid, it shall not affect the enforceability of the remaining terms.

Jurisdiction

Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts/tribunals at Chandigarh, India.

Non-Waiver

Delay or failure in enforcing any term shall not be deemed a waiver of future enforcement of that term.
